Warning vs franchiser

The Securities and Exchange Commission (SEC) yesterday issued a warning to the public against investing in franchising firm ROP Business Provider Corp., which had already closed and is not authorized to solicit investments. In an advisory, the SEC’s enforcement and compliance department warned the public to be cautious in transacting with ROP Business Provider, which is offering investment contracts and loans with a promised rate of return. The corporate watchdog said it had received various complaints. ROP Business Provider started franchising food carts in 2002.

Company officials could not be reached for comment. ROP Business Provider, which was led by businessman Ruel Pagcaliwangan, was a probationary member of the Philippine Franchise Association as of 2008. The association declined to comment. source

Potato Cuddler started with a vision to be a leading food cart business in the country. However, its beginnings were modest. It was launched in 2002 by one driven and enterprising individual who, through sheer resourcefulness and hard work, managed to come up with capital and operated his first store in a mall in Cainta, Rizal, Philippines.

Fast forward to 2005, Potato Cuddler has finally made its owner’s vision to be a leading food cart business in the country today. With around 80 outlets spread all over Metro Manila and Luzon, we have made our presence strongly felt by customers and competitors alike.

In 2004, we were awarded at the Philippine Business Excellence Awards for being the No. 1 Cart Franchise by the Awards & Recognition Association of the Philippines. In the same year, Potato Cuddler was also awarded as the Most Promising Food Cart Business by Who’s Who in the Philippines (WWP) 2004 Consumers Choice Awards.

From a venture that was began by a single individual, we have now become a corporation that employs a handful of individuals designated to different departments to cater to the growing needs of our franchisees and franchise applicants.

Not resting on our laurels, we are continually working on improving our products and services to keep pace with the changing preferences of the market and at the same time offer a profitable franchise to individuals who want to start their own business.

Our Philippine locale franchise offering consists of 2 types: The Standard Cart Franchise and the Collapsible Store Franchise.

The Cart Franchise, which is our usual store format, is ideal in malls, supermarkets, commercial establishments, airports, seaports, bus and train terminals, and amusement centers. The Cart Franchise package includes the following:

1. Uniquely-designed food cart
2. Foodservice equipment
3. Service crew uniform
4. Initial inventory of food supplies and packaging materials
5. Pre-opening support
6. Use of trade name
7. Use of trade logo

The Franchise Term is 5 years and the Royalty is 7% of Gross Sales.

The Collapsible Store Franchise, on the other hand, is ideal in school or office canteens, bazaars, flea markets, and commercial establishments requiring smaller floor area. It may also be use when catering to private parties and functions. The Franchise Package consists of the following:

1. Uniquely-designed collapsible store
2. Foodservice equipment
3. Service crew uniform
4. Initial inventory of food supplies and packaging materials
5. Pre-opening support
6. Use of trade name
7. Use of trade logo

The Franchise Term is 2 years and the Royalty is 7% of Gross Sales.
